Politician Files Fresh Suit Seeking Removal Of Mu’azu As PDP Chair
days after two separate suits challenging the emergence of Mr Adamu
Muazu as the National chairman of the Peoples Democratic Party (PDP)
were withdrawn at a Federal High Court in Abuja, a member of the party,
Aliyu Garba Gubrin, has filed a fresh suit at the court seeking the
removal of Mr Mu’azu as the chairman of the party.
Gubrin,
through his lawyer, Lilian Ojimma is contending that Mu’azu cannot
preside over the affairs of the party because his emergence as the
chairman of the party did not follow due process.
The waves of
litigation against the PDP chairman are coming as the party prepares for
its National Convention billed for December 6, where President Goodluck
Jonathan is expected to emerge as the Presidential candidate of the
party.
Named as defendants in the suit are Mr Muazu, former chairman
of the party, Mr Bamanga Tukur and the Independent National Electoral
Commission (INEC).
Gubrin is asking the court to determine whether
the resignation of Tukur on january 15, 2014 duly complies with Section
47 (5) of the Constitution of the party.
He is also asking the court
for an order setting aside the resignation of Mr Tukur as the chairman
of the PDP and an order stopping INEC from recognizing Mr Mu’azu as the
party chairman .
Last week, two members of the party, Ezinoye Louis
Ndubuisi and Emmanuel Onu filed a suit asking the court to sack the PDP
National chairman on similar grounds, they however withdrew the suit “in
the interest of the party”, they said.
