My wife slept with, had a child for my elder brother’s son, man tells court



A 74-year-old retired education director in Ikole Ekiti, Ekiti State, Gabriel Oni, has divorced his wife over alleged promiscuity and threat to life.

Gabriel had on March 4 filed a divorce suit against his wife, Funmilayo Oni, before an Ikole Ekiti Customary Court, seeking dissolution of their 40-year-old marriage.

In his evidence, Gabriel stated that he had been married to Funmilayo for 40 years and that their marriage was blessed with three children.

He sought for a divorce from Funmilayo on the allegation that she was promiscuous.

According to Gabriel, he sent Funmilayo back to Nigeria from Germany in 1977 when he discovered she was promiscuos.

He added that they reconciled in 1987 when he relocated to Nigeria and that they had two other children in addition to the one they had before she left Germany.

“She again went back to her promiscuous ways which resulted in her having a child for my elder brother’s son.

“Aside being promiscous, she’s also not humble and fights me always.

“She will threaten me in public, fight with my tenants, caretaker and claim ownership of my house,” he said.

Funmilayo, while responding, admitted that Gabriel sent her back to Nigeria from Germany in 1977 on allegation of adultery, but denied ever being involved in such.

She, however, admitted committing adultery with Gabriel’s brother’s son but denied having a child for him.

According to her, Gabriel was the biological father of her fourth child.

She prayed the court to grant her one apartment in the house built by her husband to enable her live there with their children as she had nowhere to go.

In her judgment, the court president, Mrs Yemisi Ojo, declared that Gabriel had successfully proved that the marriage to his wife had broken down irretrievably and thus, dissolved their marriage.

“On the issue of paternity of the fourth child which the plaintiff sought declaration on, this was not one of the plaintiff’s prayers before the court when he originally filed his claim,” she stated.

Ojo, in her judgment, accorded Funmilayo the privilege to continue living in the apartment she is currently occupying with her children in her husband’s house for the rest of her life
